How these Terms work

Version 1.0. Effective October 5, 2026. Earlier versions: none.

These Terms are one contract for the log.fish website, the Log.Fish app and our emails. One email address is one account on all of them. You accept these Terms once, and that acceptance covers every surface.

The Terms are in five Parts. Each Part says who it applies to.

PartSectionsApplies to
A. Everyone1 to 3Every visitor and every account
B. Anglers4 to 7Every account that logs catches
C. Pro Club members8Every account that joins a Pro Club
D. Pros9Every account that runs a Pro Club for money
E. Everyone10 to 16Every visitor and every account

One account can be in more than one Part. For example, a Pro who logs catches and joins another Pro's Club is in Parts A to E.

Part A. Everyone

1. About these Terms

These Terms are a contract between you and Out To Sea LLC, a Massachusetts limited liability company that does business as Log.Fish ("Log.Fish", "we", "us"). They apply when you use the log.fish website, the Log.Fish app, or our emails. Together, these are the "Service". If you do not agree to these Terms, do not use the Service.

1.1 Which sections apply to you

1.2 Other documents that are part of these Terms

  • Privacy Policy (log.fish/legal/privacy): what data we collect, why, and who gets it.
  • Club Code (log.fish/legal/club-code): the rules inside a Pro Club.
  • Stripe Connected Account Agreement: for Pros only, from our payment processor.

If these Terms and another document conflict, these Terms control. The one exception: the Privacy Policy controls how we handle personal data.

1.3 Words we use

  • Log: your own record of your catches.
  • Catch: one logged fish, with its photos, species, time, place, conditions, Method, bait and notes.
  • Notes: the story you add to a catch, as text, audio or video.
  • Catch Data: facts about catches, with everything that identifies a person removed and the location made general. Section 5.4 lists exactly what it contains.
  • Log Sheet: one catch, or a set of catches, that an account holder shares from their Log with a Pro Club or with a person by email.
  • Pro Club: a paid group that a Pro runs. Members pay to read the Pro's Log Sheets and posts, and to talk on the Club's Message Board. In these Terms, "Club" means a Pro Club.
  • Pro: an account holder who runs a Pro Club. Many Pros are charter captains, guides or fishing creators.
  • Pro Logger: our paid subscription for your own Log. Pro Logger is not the same as being a Pro.
  • Member: a person who has joined a Pro Club.
  • Initiation fee: the first payment to join a Pro Club. It covers the first 30 days of membership.
  • Monthly fee: the payment for each month of membership after the first 30 days.
  • Content: anything you put on the Service: catches, photos, video, audio, text, posts, your @handle and avatar.

2. Using the website without an account

You can read the public pages of log.fish without an account. When you do, these rules apply:

  • Use the website for personal, lawful purposes.
  • Do not scrape, copy or collect the website with automated tools. Search engines that obey our robots.txt file are permitted.
  • Do not use the website or its content to train AI models.
  • Do not try to get into pages that need an account or a membership.
  • Do not interfere with the website, its security, or other users.
  • The website, its design, text, logos and software belong to Log.Fish or to our licensors. You get only the right to view it.
  • Links to other websites are for your convenience. We do not control those websites.

The Privacy Policy explains our cookies and analytics. We can change or remove public pages at any time.

3. Your account

3.1 Who can use Log.Fish

  • You must be 13 or older to have an account.
  • A child under 13 can fish with Log.Fish through a parent's or guardian's account. Under these Terms, those are the parent's catches.
  • If you are under 18, a parent or guardian must agree to these Terms for you.
  • You must be 18 or older to pay for anything, to join or run a Pro Club, or to receive payouts. When you pay, you confirm that you are 18 or older.
  • If we learn that a child under 13 has their own account, we close it and delete its data.
  • You cannot have an account if we closed an earlier account of yours, or if the law does not let you use the Service.

3.2 One account, one email

  • Each account has one email address. Each email address has only one account.
  • You sign in with a link that we send to that email, or with Sign in with Apple or Google. There is no password.
  • If you use Sign in with Apple and hide your email, Apple gives us a private relay address. That relay address is the email of your account. If you later sign in with a different email, that is a different account.
  • If you use the same email on the website and in the app, it is one account. You accept these Terms once, on the website or in the app, and that acceptance covers both.
  • If you had an account before these Terms took effect, we ask you to accept them the next time you open the app or the website. Until you accept, you cannot use the parts of the Service that need an account. Catches that you logged offline still sync.
  • Anyone who can read your email can sign in to your account. Keep your email secure. You are responsible for what occurs in your account.
  • If you think someone else used your account, tell us at once at support@log.fish.

3.3 If someone else started your account

A Pro can share a Log Sheet with your email address. This can start an account for you. These Terms apply to you when you first sign in and agree to them. Until then, we keep only what we need to deliver the share.

3.4 Your email is how we give you notice

We send official notices to the email on your account. This includes changes to these Terms, price changes, membership notices and refunds. A notice is given when we send it to that address. Keep the address current and working. If our email to you bounces, we also show the notice when you next sign in.

3.5 Your @handle

  • Each account has one unique @handle. Other people see it on your public profile and on Message Boards.
  • We refuse reserved names.
  • You can change your handle, except as 9.1 says for Pros.
  • We can take back a handle that pretends to be a Pro, Log.Fish, or a public figure, or that breaks section 10.

3.6 True information

Give true information. Do not pretend to be another person.

3.7 Protections for young anglers

Many protections apply to every account, so they protect young anglers too: nobody sees an exact spot unless the angler shares it (5.2), and Catch Data never contains identity or photos (5.4). These extra protections apply to every account that we know belongs to someone under 18. A parent or guardian can tell us at support@log.fish.

  • Other people never see the location of your catches, at any setting.
  • We remove hidden data from every photo before anyone else sees it.
  • Your catches and photos never enter the use in 5.4, and never appear in our marketing.
  • In a Pro Club, other members see your @handle only, never your email address.
  • We send no marketing email to an account holder under 18.
  • A parent or guardian can ask us to see, change or delete the account at support@log.fish.

The protections stay until the account holder tells us they are 18 or older. Catches logged while the protections applied keep them permanently.

Part B. Anglers

4. Your Log and free logging

4.1 Logging is free

Every account can log catches in the app at no cost. You create catches in the app only. On the website, you can see your catches and change some details: notes, weight, length, Method and bait. The date, time, location and species of a catch do not change after you log it. To correct them, delete the catch and log it again.

4.2 What a free account gets

We record the full conditions for every catch, on every account. A free account sees its own catch details and notes, but not the detailed conditions on its catches. A free account sees the next 24 hours of the forecast. Section 6 says what Pro Logger adds.

4.3 Species suggestion from your photo

When you add a photo to a catch, the app can suggest the species. This is how it works:

  • We make a small copy of the photo (800 pixels on the long side).
  • We remove all hidden data from the copy: location, time and device information.
  • We send only that copy to our AI provider, Anthropic. We never send the catch location, spot names, or who you are.
  • We delete our copy within 24 hours. Anthropic does not use it to train its models, and deletes it within 30 days, except where the law or its safety rules require it to keep it longer.
  • The result is only a suggestion. You pick the species. Your Log shows what you pick.

When you add a photo to a catch, you let us process the photo in this way.

4.4 Conditions on your catch

We add weather, tide and other conditions to each catch. To get them, we send the catch time and its coordinates to our weather and marine data providers. We never send your name, email or account to them. Conditions data comes from other companies and agencies. It can be wrong, late or missing. Section 11 applies.

4.5 Audio and video notes

If you add audio or video notes to a catch, we make a text transcript of them and show it with the catch. The transcript follows the same privacy settings as the notes.

5. Your data, your catches, your location

5.1 You own your data

Your catches, photos, notes and other Content belong to you. We do not own them. You give us only the rights in 5.3 and, on a free account, 5.4.

5.2 Your location is yours

  • When you log a catch, the app records where you are, if you let the app use your phone's location.
  • Your catch locations are private to you. This is the default on every account.
  • Nobody sees where you caught a fish unless you share it. When you share a catch, you choose how much of its location to show.
  • You choose, catch by catch, whether a catch's photo shows in our public feed. It is off until you turn it on. A public catch shows its photo, species, month and year, and the general area it is in: a square on our map grid. It never shows the exact spot, a map pin, or coordinates.
  • Previews of shared catches never show coordinates or a map.
  • Before anyone else sees a photo or video that you post or share, we remove its hidden location, time and device data.
  • We never show your exact spot on a public page.
  • We never sell anything that identifies you, and we share it only as the Privacy Policy describes. We never share your exact spots. Section 5.4 says what we can share.

5.3 What you let us do with your Content

To run the Service, you give us a worldwide, non-exclusive, royalty-free license to store, copy, process and show your Content. We use this license only:

  • to give you the Service, as your settings tell us;
  • to show your Content to the people you share it with;
  • to back up your Content and keep the Service secure;
  • to obey the law.

This license ends when you delete the Content or your account, except as 5.4, 5.5 and 12.1 say.

5.4 Free accounts: your catches after 60 days

A free account is free because its catches help build Log.Fish. On a free account, two things can occur to a catch.

Inside Log.Fish. For 60 days after you log a catch, we use it only to run your account. After 60 days, we can also use it to build and improve Log.Fish: for example, forecasts, species suggestion and fishing insights. Nothing we show to other people from this use carries your name, @handle or exact spot.

Outside Log.Fish: Catch Data. From catches that are at least 12 months old, we can make Catch Data. We can share, license or sell Catch Data to others: for example, businesses, researchers and public agencies.

Catch Data contains only:

  • species, length, weight, and whether the fish was kept or released;
  • date and time of day;
  • Method, bait and lure;
  • weather, tide and water conditions;
  • a general area: a grid cell at least 10 kilometers (about 6 miles) on each side, or a larger fisheries reporting area.

Catch Data never contains:

  • your name, email, @handle, account or device;
  • photos or notes;
  • exact coordinates or spot names;
  • anything that links one of your catches to another of your catches.

More protections:

  • We never release Catch Data for an area and period with fewer than 10 different anglers in it. This stops anyone from working back to a spot on a small water.
  • Everyone who receives Catch Data must agree in writing not to try to identify any angler. We do not try either.

What never enters either use:

  • catches logged on Pro Logger, even after the subscription ends;
  • the catches in 3.7;
  • every catch logged before October 5, 2026, the effective date of version 1.0 of these Terms. We mark these catches, and they are never used.

Pro Logger. On Pro Logger, we use your catches only to run your account. From the day you upgrade, no catch of yours enters either use.

Your state's law. Where your state's law gives you the right to limit this use without paying, email privacy@log.fish, and we stop using your catches for it from then on, at no cost.

Our rights. For this section, you give us a perpetual, irrevocable, worldwide, royalty-free license, which we can transfer and sublicense, to make Catch Data from your catches and to use it for any purpose. Catch Data belongs to Log.Fish. Results and Catch Data that we already made stay after you upgrade, delete a catch, or delete your account.

5.5 Log Sheets you share stay in other Logs

When you share a Log Sheet with a Pro Club, each member can add it to their own Log. A member who adds it keeps it permanently. It stays if the member leaves, if the member is removed, if the Club closes, and if either account closes. They can view it only inside Log.Fish. They cannot export it.

Think before you share. You cannot take back a Log Sheet that a member has added.

While your account is open, your name stays on it. When your account is erased (12.1), the copies stay, but we remove everything that connects them to you: your name, @handle, avatar, account and Club name. We do not edit your photos or notes. If a photo shows your face or your boat, or a note contains your name, that stays.

5.6 Seeing your own data

You can view everything in your Log at any time, on every account, after any lapse, at no cost. You can ask us for a file of your own catches at support@log.fish. We send it within 45 days. Log Sheets you got from other people are not part of that file.

5.7 If Log.Fish changes owner

If Out To Sea LLC merges, is bought, or transfers the Service or its assets, your account, your Content and Catch Data can transfer to the new owner. The new owner must keep the promises in these Terms and the Privacy Policy for all data collected under them. To change a promise for data it already holds, the new owner must get your agreement. We tell you by email when a transfer occurs.

6. Pro Logger subscription

6.1 What you get

Pro Logger shows the full conditions on every catch in your Log, the full forecast range and its map overlays. The monthly plan and the annual plan unlock the same things.

6.2 Price and payment

  • The price is $9.99 a month or $99 a year, plus tax where it applies. The price shown at checkout controls.
  • If you buy on the website, we charge your card through Stripe.
  • If you buy in the app, Apple or Google charges you. Their terms apply to that payment.

6.3 Automatic renewal

Your subscription renews automatically at the end of each month or year, at the price then in effect. It continues until you cancel. If you bought on the website, we email you a reminder 15 to 30 days before each annual renewal. Apple and Google send their own reminders for app purchases.

6.4 How to cancel

  • Bought on the website: cancel at log.fish/account.
  • Bought in the app: cancel in your Apple or Google account settings.
  • When you cancel, you keep Pro Logger until the end of the period you paid for. Then your account becomes a free account. Your Log and every catch in it stay.

6.5 Refunds

We do not refund part of a period, except where the law requires it and as 13.4 says. For an app purchase, Apple or Google decides refunds.

6.6 Price changes

We can change the Pro Logger price. We email you at least 30 days before the new price applies to you. It applies at your first renewal after that. If you do not want the new price, cancel before then.

6.7 Pro Logger for Pros

A Pro who runs a Pro Club with payouts connected gets Pro Logger at no charge. This continues while we retry a failed payout (9.10). It ends at once if the Pro disconnects payouts or the Club closes. It starts again if the Pro connects payouts again. Catches that a Pro logs while on Pro Logger follow 5.4 like any Pro Logger catch.

7. Free Clubs

Log.Fish does not offer free Clubs at this time. Every Club is a Pro Club, and section 8 applies. If we add free Clubs, we add their rules to these Terms first, as section 13 says.

Part C. Pro Club members

8. Joining a Pro Club

8.1 Who does what

A Pro runs each Pro Club. The Pro decides the price, the content, and who stays in. Log.Fish supplies the tool, takes your payment, and pays the Pro. Log.Fish does not run the Club and does not guarantee what the Pro shares.

8.2 Price and renewal

  • The Pro sets two prices: an initiation fee and a monthly fee. Before you join, we show both, for example "$99 to join, then $49 a month".
  • The initiation fee covers your first 30 days. The monthly fee starts on day 31.
  • You enter your card when you join. If the Club approves each member, we save your card and charge it only when the Pro approves you. If the Pro declines you, we charge nothing.
  • Log.Fish charges your card. Your card statement shows Log.Fish, not the Pro.
  • Your membership renews every month at the monthly fee. It continues until you cancel, or until it ends as this section says.
  • If a monthly payment fails, we try again for 7 days. If it still fails, your access pauses until the payment succeeds or you cancel.

8.3 The Club Code

When you join, you agree to the Club Code. The main rule is this: do not share what you see in a Pro Club outside the Club, unless the Pro gives you express permission. If you break the Club Code, you can lose your membership. If you leak Club content systematically, you can lose your Log.Fish account, with no refund (12.3).

8.4 You cancel

  • You can cancel at any time at log.fish/account. You keep access until the end of the period you paid for. Then the membership ends.
  • We do not refund any part of a period.
  • The initiation fee is final when you join, because it opens the Club's catches from the 30 days before you joined (8.8) at once.

8.5 The Pro removes you

A Pro can end your membership at any time, with no warning and no reason. When this occurs:

  • We refund the unused part of your current period on the same day. In your first 30 days, this includes the unused part of the initiation fee.
  • Your bank decides when you see the refund.
  • You cannot join that Club again unless the Pro lets you.

8.6 The Pro closes the Club

  • We email you when the Pro announces the closure. Renewals stop.
  • On the closing date, we refund the unused part of your current period automatically.
  • On the closing date, you can no longer read the Club's archive.
  • Log Sheets that you added to your Log stay with you (8.8).

8.7 Archive access

Each Pro Club sets how much of its archive a member can read. Some Clubs open a deeper archive after 12 months of continuous membership. If your membership stops and you join again, the 12 months start again.

8.8 Log Sheets you keep

  • You can add a Pro's Log Sheet to your Log only if the catch occurred during your membership, or in the 30 days before you joined. The catch date counts, not the date the Pro shared it.
  • A Log Sheet that you add stays in your Log permanently. It stays after you cancel, after removal, after the Club closes, and after either account closes.
  • Your copy follows your own account: on a free account, its detailed conditions are hidden, as on your own catches (4.2).
  • The Pro's name stays on it while the Pro's account is open. If the Pro's account is erased, we remove the Pro's name and Club name from it (5.5).
  • You can view it only inside Log.Fish. You cannot export it. Do not share it outside Log.Fish, except as the Club Code permits.

8.9 Price changes

If the Pro changes the monthly fee, we email you the date when it applies to you. The new fee starts at your first renewal at least 30 days after our email. Only one price change can be pending at a time: a new announcement replaces it, and the 30 days start again. If you do not want the new fee, cancel before that date.

8.10 What the Pro sees about you

  • The Pro sees your name and email address, and can download them.
  • The Pro sees on which days you read the Club and what you opened.
  • Other members never see your email address.
  • Other members see your @handle and avatar only in Clubs where you post.

The Privacy Policy gives the details.

8.11 If the Pro has a payout problem

If we cannot pay the Pro, the Club continues to work for you as usual. Nothing closes and nothing is refunded because of it.

8.12 A problem with a charge

Contact us first at support@log.fish. We answer within 5 business days. If you dispute a charge with your bank instead, your membership ends at once, with no further refund. When the dispute is closed, you can join again if the Pro lets you.

8.13 If the Club changes owner

A Pro can hand a Pro Club to another owner. If this occurs:

  • Your membership continues unchanged, with the same terms, price and renewal date.
  • A price change that was already announced takes effect as announced.
  • We email you once, with the name of the new owner.
  • The new owner receives all that the old owner saw about you: your name and email address, your activity in the Club, and the Club's Message Board and questions. The new owner must obey the same rules as any Pro (9.13).
  • After that, the new owner can change the price or end your membership only as any Pro can (8.5, 8.9).

Part D. Pros

9. Running a Pro Club

9.1 Who can be a Pro

  • You must be 18 or older.
  • Before members can join, you must set up payouts with Stripe (identity, bank and tax information) and accept the Stripe Connected Account Agreement. You can build your Club and its content before that.
  • Each new Pro Club passes a fraud and compliance review before payouts start.
  • When you open your first Pro Club, your @handle locks. To change it after that, contact support@log.fish.
  • You can run more than one Pro Club. One Stripe account serves all of them. This section applies to each one.
  • You are an independent business. You are not our employee, agent or partner.

9.2 Your price

You set an initiation fee and a monthly fee. Each must be at least $5. There is no maximum.

9.3 How the money works

  • Log.Fish is the seller of record. We charge the member's card.
  • From each payment, we first take the card processing fee that the processor actually charged on that payment. From what remains, we keep our platform fee of 10%. The rest is your share. There are no other fees. You pay no subscription.
  • If we show you a processing figure before a charge exists, it is an estimate. Your payout uses the actual figure.
  • We send your share to your Stripe account 7 days after the member's payment settles. You are not paid when the member is charged.
  • We record every charge, fee, transfer, refund and dispute with the processor's own numbers. That record decides what we paid you.

9.4 Refunds come from your balance

  • When you remove a member or close your Club, the refund is automatic. You cannot stop it.
  • The refund comes from your share. We refund our share of the fee in proportion.
  • The processor does not return card processing fees. You bear them.
  • If your balance is too low, it can go negative, as the Stripe terms say.

9.5 Chargebacks and disputes

If a member disputes a charge, you bear the disputed amount and the dispute fee. We recover them in one of three ways: we reverse a transfer, we take them from your next transfer, or we debit your Stripe account. A dispute can arrive months after we paid you. We do not absorb disputes for you. We recover later processor fees and adjustments in the same way.

9.6 Changing your price

  • We email your members automatically.
  • New members pay the new price at once.
  • Existing members pay the new monthly fee at their first renewal at least 30 days after our email.
  • If you announce a new price again, the new announcement replaces the old one, and the 30 days start again.

9.7 Archive setting

You choose your archive setting before your first member joins. After that, only our support team can change it.

9.8 Approving and removing members

  • You choose whether your Club approves each member or lets members in automatically.
  • You can remove any member at any time, for any reason or none. The member gets the automatic refund in 8.5. The member cannot join again unless you let them.

9.9 Closing your Club

  • You choose a closing date. It can be any day from the announcement to 90 days after it.
  • New joins and renewals stop at the announcement.
  • Refunds occur on the closing date.
  • You can cancel the closure before the closing date.
  • Your Club's web address is never used for another Club. It stays with your Club if you hand the Club over (9.16).
  • We still send your year-end tax documents.

9.10 If we cannot pay you

If Stripe cannot pay you (a restricted account, missing information, or a failed transfer), we hold your share, try again, and remind you. We take no other action. Your Club stays open and your Pro Logger continues. If the money stays unclaimed for the period that the unclaimed-property law sets, we follow that law, which can require us to send the money to a state.

9.11 Your content

  • You are responsible for what you publish in your Club.
  • You must have the right to show all that you post or embed, including YouTube videos, Instagram posts, podcasts and articles. We do not check this.
  • When you use an AI writing button, we send our AI provider only the text you typed, your Club's name, and its home water. We never send member data. Nothing is published until you save it. You are responsible for what you publish.

9.12 Your Message Board

  • You moderate your Club's Message Board. You can pin, lock and delete threads, replies and media.
  • You must act on reports that we send you.
  • You are not responsible for member posts that you have not seen.
  • We act only on reports sent to us, and by closing accounts.

9.13 Member data

You get your members' names and email addresses. You must follow these rules:

  • Use them only to run that Club.
  • Do not add them to other lists, sell them, or give them to anyone.
  • Do not contact a member after they leave, unless they agreed to it separately.
  • Obey the privacy and anti-spam laws that apply to you.

9.14 Taxes

You are responsible for your own taxes. Where the law requires it, we issue year-end tax documents, including for closed Clubs.

9.15 Fair dealing

  • Do not promise members results, catches or spots that you cannot deliver.
  • Do not take payment outside Log.Fish for membership in your Pro Club, and do not send members to pay you elsewhere for the same access. Charter trips, guided trips and gear that you sell are not part of this rule.

9.16 Handing your Club to another owner

You can hand your Club to another owner. The new owner must accept your invitation on the website. These rules apply:

  • A payout goes to whoever owns the Club when we pay it. Money already paid to you stays yours. Money not yet paid to you at the hand-over goes to the new owner. This includes money still inside the 7-day hold.
  • After the hand-over, the new owner bears every refund, dispute and card-processing fee, on any payment, whenever it was collected. We do not reverse your earlier payouts.
  • Until the new owner's payouts are set up, the Club takes no new members, and the new owner cannot remove a paying member or close the Club. We hold the new owner's share until then. A dispute, or a refund that nobody on Log.Fish caused, that arrives before then comes out of that held share.
  • If a member of the Club takes it over, their membership ends with no refund. If their membership still renews, they must end it before you invite them.
  • After the hand-over, you stay a member of the Club at no cost, and you can read its whole archive. This right stays if the new owner removes you and later lets you back in.
  • Your access to the members list ends at the hand-over. Delete any copy of the members list that you downloaded, unless a member agreed separately that you can keep their details. Section 9.13 continues to apply to any copy until you delete it.

Part E. Everyone

10. Content and conduct

10.1 Rules for everyone

Do not use the Service to:

  • break any law, including fishing laws;
  • post Content that you do not have the right to post;
  • harass, threaten or impersonate any person;
  • post sexual content, hate, or threats of violence;
  • post another person's private information, including their spots, without their permission;
  • send spam, or advertise without our permission;
  • scrape or collect data from the Service with automated tools, or use it to train AI models;
  • get into accounts, Clubs or Content that you are not entitled to see;
  • upload malware, or attack or overload the Service;
  • sell or share Pro Club content outside the Club.

10.2 Message Board

  • The Club Code applies to the Message Board.
  • The Pro can remove any thread, reply or attachment, without notice or reason.
  • When you upload a photo or video, you let us process it (convert it and remove hidden data such as location) and show it to the members of that Club who are entitled to see it.
  • You must own, or have the right to use, all that you upload.
  • If a Pro removes you from a Club, your posts stay unless the Pro deletes them. If you delete your account, they stay with your name removed (12.1).

10.3 Content from other platforms

Some Pro Clubs show videos or posts from YouTube, Instagram and other platforms. When you open a page that shows one, your browser connects directly to that platform. That platform can see the request, as if you opened the video on its own site. We send that platform nothing about you. Its own terms and privacy policy apply to what it collects.

10.4 Reports and removal

You can report Content to us at abuse@log.fish, or with the Report button where the Service shows one. We can remove Content, or restrict or close accounts, that break these Terms. We do not review all Content. We are not responsible for Content that other people post.

10.5 Copyright complaints

If you think Content on the Service infringes your copyright, send a notice to our designated copyright agent at copyright@log.fish. The agent's full contact details are in the U.S. Copyright Office's DMCA Designated Agent Directory. We follow the notice-and-counter-notice process of U.S. copyright law. We close the accounts of repeat infringers.

11. Fishing, forecasts and safety

  • Forecasts, weather, tide and conditions data can be wrong, late or missing. Do not use Log.Fish for navigation, or to decide if it is safe to go on the water. Use official marine forecasts and your own judgment.
  • You are responsible for obeying fishing laws: licenses, seasons, size and bag limits, closed areas, and private property. We do not check if a spot is legal to fish or safe to get to.
  • Species suggestions are guesses. Check the species yourself, especially where a law depends on it.
  • Pros and members share their own experience. We do not check it and do not guarantee results.
  • A Pro Club is not a charter booking or a guided trip. Any trip you arrange with a Pro is between you and the Pro.

12. Ending your account

12.1 You delete your account

You can delete your account in the app or on the website. First:

  • If you run a Pro Club, close it (9.9) or hand it over (9.16).
  • Turn off Pro Logger and every paid membership, so that nothing renews. If you bought Pro Logger in the app, turn it off in your Apple or Google settings. We cannot see or stop a store subscription for you.

When you delete your account:

  • Every membership ends at once. We do not refund any unused paid period.
  • We deactivate your account at once. If you sign in within 30 days, we restore it.
  • After 30 days, we erase your personal data: your name, @handle, email, phone number, photo, profile, sign-in details and settings. We also erase the photos and notes on the catches in your own Log.

After erasure, we keep these:

  • Your catch records, without photos or notes and unlinked from you. They keep the place and time of the catch, but nothing that connects them to you. Nobody sees them. We use them only as 5.4 allows. When any of them leaves Log.Fish, it is only as Catch Data, with the location made general.
  • Results and Catch Data already made from your catches (5.4).
  • Your Message Board posts and replies, and your direct messages, with your name removed. The person you wrote to keeps the conversation.
  • Log Sheets that members added to their Logs, with your name removed (5.5).
  • Payment and tax records, for as long as the law requires.
  • Backups, until we delete them on our normal schedule, within 35 days.

12.2 We suspend or close your account

We can suspend or close your account for these reasons:

  • You break these Terms or the Club Code in a serious way, or again and again. Systematic leaking of Pro Club content is serious.
  • The law requires it.
  • It is necessary to protect other users or the Service.

We tell you why, unless the law or safety prevents it. If you think we made a mistake, reply to our email within 30 days. A person reviews your reply and answers within 14 days.

12.3 No refund when we close your account

If we close your account because you broke these Terms, we refund nothing. This includes Pro Club memberships and Pro Logger. The reason: a refund for a Pro Club comes from the Pro's balance, and the Pro is the person you harmed. This is the only case on Log.Fish where nothing is refunded.

12.4 When access stops

When an account is closed or deleted, website access stops at once. The app can continue to work for up to 30 days, until its sign-in expires. Then it stops.

12.5 What continues after an account ends

These sections continue: 5.4 (our rights in Catch Data), 5.5, 5.7, 8.8, 9.3 to 9.5 (money that is owed), 9.13, 9.16, 10.5, 11, 12 and 14. If we close your account under 12.2, you lose access to everything in it, including Log Sheets you added.

13. Changes to these Terms

13.1 Versions

We can change these Terms. Each version has a number and an effective date at the top. Old versions stay at log.fish/legal/terms/history.

13.2 Notice of a material change

A material change is a change that affects your rights or duties. For a material change:

  • We email the address on your account at least 30 days before the change takes effect.
  • We show a notice on the website and in the app during those 30 days.
  • The notice tells you, in plain words, what changed and when.

For a small change (a typo, clearer words, new contact details), we post the new version and update the date. We do not send an email.

13.3 Changes that cannot wait

A change can take effect sooner when the law requires it, or to stop fraud, abuse or a security risk. We still email you.

13.4 Your choice

  • For a material change, we ask you to accept the new Terms before you continue to use the parts of the Service that need an account.
  • For other changes, if you continue to use the Service after the effective date, the new Terms apply to you.
  • If you do not agree, stop using the Service and delete your account.
  • If you bought Pro Logger on the website and a material change reduces your rights, you can cancel. We then refund the unused part of your current period. For app purchases, Apple or Google decides refunds.

13.5 Limits on changes

  • A change does not apply to a dispute that started before the change took effect.
  • Price changes follow 6.6, 8.9 and 9.6, not this section.

14. Legal terms

14.1 The Service is provided "as is"

We work to keep the Service available and correct. We do not promise that it is free of errors or always available. We do not promise that conditions data, forecasts or species suggestions are correct. As far as the law permits, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

14.2 Limit of our liability

As far as the law permits:

  • We are not liable for indirect, incidental, special or consequential damages, or for lost profits or lost data.
  • Our total liability for all claims is limited to the greater of: what you paid us in the 12 months before the claim, or $100.

Some places do not permit these limits. There, they apply only as far as the law permits.

14.3 Your responsibility to us

You will defend us and pay for claims against us that come from your Content, your Club, your use of member data, or your breach of these Terms.

14.4 Disputes

Governing law. The laws of the Commonwealth of Massachusetts govern these Terms, without regard to its conflict-of-law rules. The Federal Arbitration Act governs this section 14.4.

Talk to us first. Before you start a claim, email legal@log.fish with your name, your account email, the problem and what you want. We do the same for you at your account email. Each side gives the other 30 days to fix the problem.

Arbitration. If the problem is not fixed, you and Log.Fish resolve every dispute by binding arbitration, one person at a time, under the Consumer Arbitration Rules of the American Arbitration Association. A hearing occurs by video, or in the county where you live. Your share of the fees is never more than the fees to file in court. The arbitrator decides only your claim, and can give you the same relief that a court can give one person.

No class actions. You and Log.Fish bring claims only for yourselves, never as a plaintiff or class member in a class, group or representative action.

Many similar claims. If 25 or more similar claims are filed by the same or coordinated lawyers, the AAA handles them in groups of 25. The other claims wait, and their time limits stop running while they wait.

Exceptions. Either side can bring a claim in small-claims court if it qualifies. Either side can ask a court to stop the misuse of its intellectual property.

Opt out. You can opt out of arbitration. Email legal@log.fish within 30 days after you first accept these Terms, with your name and account email, and say that you opt out. If you opt out, or if a court decides that arbitration does not apply, claims go to the state or federal courts in Massachusetts, and you and Log.Fish accept their jurisdiction.

14.5 General

  • These Terms and the documents in 1.2 are the full agreement between you and us.
  • If a court finds part of these Terms unenforceable, the rest stays in force. If the class-action waiver is found unenforceable for a claim, that claim goes to court, not to arbitration.
  • If we do not enforce a term, we do not give up our right to enforce it later.
  • You cannot transfer these Terms. We can transfer them to a company that takes over the Service, as 5.7 says.
  • We are not liable for delays that events outside our control cause.
  • You must not use the Service if the law of the United States or of your country forbids it.

15. Apple and Google

If you got the app from the Apple App Store or Google Play, these terms also apply:

  • These Terms are between you and Log.Fish only, not Apple or Google. Log.Fish alone is responsible for the app.
  • You can use the app only on devices that you own or control, as the store's rules permit.
  • Apple and Google have no duty to maintain or support the app.
  • If the app does not do what we promise, you can tell Apple, and Apple can refund the price you paid for the app. Apple has no other warranty duty.
  • Log.Fish, not Apple or Google, handles claims about the app, including product liability, legal compliance, consumer protection and intellectual property claims.
  • You confirm that you are not in a country under a U.S. embargo, and not on a U.S. government list of prohibited persons.
  • You must obey the terms of other services that you use with the app, such as your mobile carrier.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and can enforce them against you.
